Five years without gaps

Permanent status is not built in the last month of the fifth year. It is created by renewals, real dates of residence, the absence of gaps in the documents, and a timely reaction to changes.

Read in order

Residencia de larga duración usually becomes available after five years of legal and continuous residence. But study-based stays, long absences, and different types of permanent status are counted under their own rules.

When the routemakes sense

  • Your current card is coming up for renewal.
  • The basis has changed and a modification is needed.
  • The five-year residence mark is approaching.
  • A long trip outside Spain or the EU is planned.
  • You need to compare permanent residence and citizenship.
01

Renewal starts with the calendar

For each card, the start and end, the permitted filing window, and the requirements for income, work, insurance, and taxes are recorded. If the basis has changed, sometimes it is not an ordinary renovación that is needed, but a modificación.

Filing within the permitted period often extends the validity of the previous authorization until a decision is made, but proof of filing must be kept. After approval, the physical TIE is updated.

02

Five years is not just the difference between dates

For national larga duración, legal continuous residence and permitted absences are assessed. The larga duración-UE status has additional conditions and a different mobility potential.

Periods of study may be counted differently, especially for the larga duración-UE regime, where under certain conditions part of the time is counted. That is why the history of statuses is broken down by days and by legal category.

03

Citizenship is a separate procedure

The general rule for nacionalidad por residencia is ten years of legal continuous residence, but for some nationalities and circumstances the term is reduced. Marriage to a Spanish citizen does not issue a passport automatically.

Continuity, good civic conduct, integration exams, and civil-status documents are checked. The consequences for the previous nationality are analyzed separately.

Short answers

If the answer changes with a single fact, that is not a detail — it is a reason to review the situation separately.

01Is permanent residence always after five years?

Five years is the general basis for long-term residence, but legality, continuity, types of status, and absences are taken into account.

02Do studies count toward these five years?

A study-based stay is not the same as ordinary residence. For larga duración-UE, part of the study time may be counted if the conditions are met.

03Can you apply for citizenship right after marriage?

Marriage by itself does not grant citizenship. It may shorten the required period of legal residence if the remaining conditions are met.

04After permanent residence, is the card no longer replaced?

The right to permanent residence and the physical TIE are not the same thing. The card is renewed on the established schedule.
